LHS Athletic Boosters Terms and Conditions
The Lyman High School Athletic Boosters Club Membership and its benefits are offered at the sole discretion of the Lyman High School Athletic Boosters Club Board of Directors. 1. Lyman High School Athletic Boosters. The Membership Program is operated by (Who what) (Address, City, State) and is administered on its behalf by the appropriate board member. 2. Membership Eligibility and Fees. Membership is available to individuals (“you”) as stated in these membership Terms and Conditions. You may maintain only one account. Companies and/or other entities cannot enroll. The cost of the membership is based upon the members need to gain access to sports events at Lyman High School.3. Definitions and Terminology: The LHS Athletic Boosters Club defines and identifies the following membership passes as follows: a) Annual Sports Pass- A one calendar school year pass to any regularly scheduled sporting event held at Lyman High School during the Fall, Winter, or Spring. I. All Sport Pass- A pass which allows access to any regularly scheduled sporting events at Lyman High School. This does not include play-off or special events. c) Season All Sport Pass- An All Sport Pass Valid during one of the sports seasons. The seasons are Fall, Winter or Spring and the Pass is specific to the season requested by the buyer. 4) Individual Membership. LHS Athletic Boosters reserves the right to restrict, suspend, discontinue or cancel any membership upon written notice to any or all active members. Current memberships available are: a) Blue and Gold Membership The Blue and Gold Membership is a family level membership. It provides a default package of two memberships with the ability to add immediate family members.i) 2-Persons Membershipii) 2-Seat Cushionsiii) 2-A Key Chainsiv) 10% off on all purchases at the Kennel Klub Storev) invitation for (2) to the Lyman Athletic Boosters Home Coming Tailgate Partyvi) Name on LHS Athletic Booster Club Blue and Gold Member Bannervvii) 2 – Annual Passes to ALL-Sporting Events at Lyman High Schoolviii) All Memberships begin on August 1st of current school year.ix) Additional Family Member Memberships are an additional cost for each member.Note: (1) LHS Athletic Booster Club Members are added to the “Banner” in August, December and February. Only. b) Gold Membership The Gold Membership is a “Single Membership” for one person and one Season All-Sport Pass.. i) 1-Person Membershipii)ii) 1 Seat Cushionsiii) A Key Chainiv) iv) 10% off on all purchases at the Kennel Klub Storev) Invitation for (1) to the Lyman Athletic Boosters Home Coming Tailgate Partvi) 1– Season All-Sport Pass to ALL-Sporting Events at Lyman High School during the season selected. vii) All Memberships begin on August 1st of current school year.Note: (1) This is a single person membership.(2) Additional Seasons may be added to the Season All-Sport Pass(3) The Single Season All Sport Pass may be upgraded to an Annual All-Sport Pass c) Blue MembershipThe Blue Membership is for a single season of sporting events and for a single person. I. A Key Chain II. 10% off on all purchases at the Kennel Klub Store III. Invitation for (1) to the Lyman Athletic Boosters Home Coming Tailgate Party IV. One Single Season Sport Pass for a Fall, Winter, or Spring sport season at Lyman High School. All Memberships begin on August 1st of current school year.Note: 1) Additional Seasons can be added to the Season All-Sport Pass.2) Can be upgrade to Annual All-Sport Pass.5) Membership Cancellation. LHS AB reserves the right to cancel any membership and revoke any and all benefits being received by any member for reasons that include, but are not limited to: 1) violation of these Terms and Conditions; 2) misrepresentation of any information or any misuse of the membership; 3) violation of any national, state or local law or regulation in connection with the use of membership privileges; 4) failure maintain proper etiquette and presence during an athletic event; 5) payment for membership that is returned for insufficient funds or is invalid for any reason; 6) commission of fraud or abuse involving any portion of this membership; 7) more than one active account per member; or 8) action, in any other way, to the detriment of the LHS Athletic Boosters image, reputation or any of its alliances; all as may be determined by LHS Athletic Boosters Board in its sole discretion. 6 5. Changes in Terms and Conditions. LHS Athletic Boosters reserve the right to change, limit, modify or cancel Program Terms and Conditions (including the number of seasons), regulations, benefits, conditions of participation, membership levels in whole or part at any time, even though changes may affect the benefit already purchased. You will be bound by any such changes. 6. Notice of Changes. Any such changes will be shown in these Terms and Conditions on the LHS Athletic Boosters web site (www.lymanboosters.com) and will be effective immediately unless stated otherwise. A notice that a change has been made will be placed on the web site for a reasonable period of time. Any changes to any printed version of the Terms and Conditions will be contained in the next reprinting of that printed version. LHS Athletic Boosters will attempt to notify active members of major Program changes, but will not be liable for failure to do so, and all members will nevertheless be bound. An active member is defined as any member having paid in full all membership fees within the designated school year as 76 the last 12 months. 7. Legal rights. Neither the Membership nor any benefit offered by the Membership creates, constitutes or gives rise to any legal or contractual rights by members against LHS Athletic Boosters. 8. Data Privacy. Under the data protection legislation of the United States, we are required to particularly draw your attention to the fact that by applying for membership or by continuing to exercise the privileges of membership, you accept and explicitly authorize that your personal information which is supplied by you in the enrollment form or during the course of your membership (i) shall be processed by LHS Athletic Boosters, in its capacity of data controller (ii) may be transferred worldwide to any third parties with which LHS Athletic Boosters is affiliated within the scope of the business of the membership and business of LHS Athletic Boosters or to third parties to process your personal data on our behalf or where required by applicable law or in the event of a company reorganization, merger or acquisition, for use of such information for its (their) administration of membership records, service, advertising, marketing and communication purposes. They or we may contact you for marketing purposes by mail, fax, telephone or email. Also, as an additional value-added benefit, we are offering you the opportunity to receive information on goods or services that may be of interest or value to you by providing various companies a mailing list of LHS Athletic Club members. 9. Right of Access to Data. You have a right of access to your data by sending a written request to the LHS Athletic Boosters Club10. Communications Not Received. LHS Athletic Booster Club is not liable for loss of misdirected correspondence, requests, that may be incomplete, illegal, delayed, lost or stolen. 11. No Guarantees on Merchandise. LHS Athletic Club, its affiliates, and agents make no guarantees, warranties or representations of any kind, expressed or implied, with respect to items of merchandise purchase through LHS Athletic Club, and shall not be liable for any loss, expense (including without limitation, any legal fees), accident or inconvenience that may arise in connection with the use of such items or as a result of any defect or failure of such items. Any implied warranties of merchantability or fitness for a particular purpose are specifically disclaimed. 12. Program Violations. Program violations, fraud or abuse in relation to membership usage is subject to appropriate administrative and/or legal action by appropriate governmental authorities and by LHS Athletic Boosters Club, Lyman High School, the Seminole County School Board, including, without limitation, the forfeiture of all membership benefits, vouchers, or merchandise issued pursuant to your account, as well as cancellation of the account and your future participation in the LHS Athletic Boosters Club. 13. Membership Purchases. You may purchase only one membership per family, additional immediate family members may be added to the family membership at an additional cost. Immediate family members are your children’s grand parents, your children, and any child under your guardianship. No cancellations or refunds are permitted. 14. Membership Transfers. You may not transfer your membership. 15. Program Interpretation. Interpretations of Program Terms & Conditions shall be at the sole discretion of LHS Athletic Booster Club. LHS Athletic Booster Club reserves the right to add, modify, delete or otherwise change these Terms and Conditions or any rules related to the membership at its sole discretion, with or without notice.
